The ruling that dismissed Vox's appeal against Telde City Council regarding the situation of councillor Janoa Anceaume is final. The court confirms that the municipal action was legal and orders costs against spokesperson Rita Esmeralda Cabrera.
The litigation between Vox and Telde City Council concerning the situation of councillor Janoa Anceaume Delgado has come to an end. The ruling issued by the Administrative Litigation Section of the Court of First Instance of Las Palmas de Gran Canaria is now final, as no appeal was filed within the legal timeframe. The judgment fully dismisses the political party's claims and upholds the municipal management.
The procedure was initiated following the appeal lodged by Vox spokesperson in Telde City Council, Rita Esmeralda Cabrera. The councillor alleged a supposed administrative inactivity of the council regarding the political and administrative situation of Janoa Anceaume, a councillor who joined the Municipal Government under a specific dedication regime. Cabrera questioned certain municipal agreements linked to that process.
However, the court concludes that the alleged inactivity did not exist. The ruling states that the route used by the appellant was not appropriate for raising their claims. Furthermore, it recalls that the questioned municipal agreements had become final as they were not challenged within the time limits set by law.
The judicial resolution also imposes the costs of the procedure on the appellant. The estimated amount is around 2,000 euros, which Rita Esmeralda Cabrera will have to pay, according to what is established in the ruling and the cost determination procedure.
The mayor of Telde, Juan Antonio Peña, has positively assessed the firmness of the ruling. In official statements, the mayor emphasized that “the firmness of this ruling confirms that the City Council acted at all times with responsibility, transparency and absolute respect for the law.” Peña added that “from the municipal government, we always defended that the decisions made were correctly founded, and today Justice endorses that action.”
The municipal leader insisted that “this resolution puts an end to a procedure that aimed to generate doubts about municipal management and which the courts have dismissed.” He also stated that “the City Council will continue to work from legal and administrative rigor, focusing its efforts on improving Telde and addressing the needs of the citizens, leaving behind debates that have been resolved by Justice.”
The case has generated interest in the local political sphere, as it involves a judicial confrontation between a municipal group and the City Council itself. Councillor Janoa Anceaume, whose situation was the origin of the appeal, continues to be part of the governing group. Municipal sources have confirmed that the councillor is carrying out her duties normally.
With this final ruling, a chapter that questioned the legality of the agreements adopted by the Telde council is closed. Justice has been clear in dismissing any irregularity, which reinforces the position of the local government for future actions.
